The Dynamic Nature of Law Research

Jul 04

In today’s scenario, it requires each and every lawyer to carry out legal research, regardless of the area of expertise. Further, the very first step in any legal research is hitting upon the main case which is connected to the respective issues. However, this is quite a difficult task due to certain factors. Some of these include the wrong identification of the issues or else the missing of the same. In fact, the identification of issues is very important for conducting effective research.

Since the field of law is ever changing, the decision of the court would differ with regard to each case, and sometimes conflict arises in certain decisions. To avert such kind of situations, you are required to conduct proper research of law with respect to other jurisdictions, and either use creative analysis to the already prevailing rules or build up an argument according to the first principles.

The Complicated Aspect of Legal Research in the Present Times

Though there are a variety of tools for carrying out legal research when compared to our forerunners, research has turned out to be much more difficult. In fact, the need to update knowledge and skill sets has become very essential. Also, there has been a steep increase in case laws and related materials. For getting a basic idea about all these, you are required to perform efficient and in-depth legal research. To materialise this, you would have to formulate a research strategy and adopt a useful research methodology. A particular strategy could be developed once you have become familiar with the existing resources, and the effectiveness of your strategy would depend upon the speed with which you develop it.

Modern Trends in Legal Research

According to its objectives as well as the method of inquiry, legal research can be classified into either mono-disciplinary or trans-disciplinary. The legal researchers analyse each doctrines, statutory provisions, and legal terminologies based upon judicial declarations. This kind of research depends solely upon the law discipline. Since only one discipline is involved here, this category is termed as mono-disciplinary legal research. However, certain new trends have emerged recently in the field of law. They try to transgress the law discipline and at the same time cover other disciplines associated with law. This category is given the name trans-disciplinary. It possesses much potential to contribute towards the knowledge and advancement of law since it depicts a holistic approach of the legal issue in question.

Trans-disciplinary research is sub-divided into multi-disciplinary, quasi-disciplinary, and inter-disciplinary legal research.  Multi-disciplinary research deals with the analysis of a common fact by experts of different disciplines, from their own perspective. Quasi-disciplinary research is conducted by a particular law scholar from different angles which interrupt the law discipline. Inter-disciplinary research is conducted jointly by experts from several disciplines.

To summarize, the scope of legal research is very vast in today’s social settings.
